-Airbnb has instituted a "Global Party Ban" and limited the total number of people at a house to 16. Airbnb has stated that they may pursue anyone who violates this ban legally. This house is in a nice part of Dallas and is part of an HOA that restricts loud gatherings, so absolutely no amplified music. The house and pool area have speakers throughout for guests to use. We want everyone to enjoy their time at the house, but not to the detriment of our neighbors and at the risk of being delisted on Airbnb.

-All pets must be disclosed prior to check-in and there will be a pet fee.

This charming home is an architectural gem from the famous Texas architect, Charles Dilbeck. As you first pull into the gravel driveway, you'll be greeted by lush landscape and architecture reminiscent of Colorado. As you open the front door you are invited into a home that greets you with charm around every corner. From the large fireplace to the wood ceiling beams to the tiled ceiling accent, these little funky details are at every turn. Entertain guests or just relax and enjoy this private pool and spa that is surrounded by lush greenery from every angle. This truly unique property sits at the edge of a greenbelt, so you gaze unto infinite greenery. Flowing waterfalls trickle into both sides of the pool creating an atmosphere that reminds you of a Palm Springs vacation home. Sip your cocktail as you get a tan, relax with your family or friends, and make wonderful memories.

Short Term Rental Agreement

Dear Guest,
We’ve tried to make our house as comfortable as possible, but we do ask that you please abide by our house rules. As noted on our listing, by booking our home, it confirms that you acknowledge and agree to abide by our rules and this contract.


This Lease Agreement (the “Agreement”) is made by and between Mark Hefflefinger (“Homeowner”) and (“Guest”) as of the date last set forth on the agreement made
via the Airbnb/VRBO website. For good and valuable consideration, the sufficiency of
which is acknowledged, the parties hereby agree as follows:

1. Property: The property address is _____________ Dallas, TX 75209

2. Maximum Occupancy: Maximum number of guests is limited to the number listed on the booking via Airbnb/VRBO. The rental party shall consist of all Adults and Children (under age 18).

3. Term of the Lease: The lease begins at 4:00 p.m. on (the “Check-in Date”) and ends at 11:00 a.m. on (the “Check-out Date”). No refunds are issued for late check-in or early departure. Additionally, refunds are not issued for a change in the guest count after booking.

4. Rental Rules: Guest and all members of the Rental Party agree to abide by all local, state, and federal laws and regulations at all times in conjunction with the rental of the property. Guest and anyone else Guest permits on the property agree to abide by the Rental Rules attached as Exhibit A and the Welcome Book at all times while at the property. Violation of these rental rules will result in fines or eviction. At the termination of this Lease, Guest shall quietly yield up the Property in a good and habitable condition in all respects, as it was when the Guest took possession.

5. Access: Guest shall allow Homeowner and their agents access to the property at all times for purposes of repair, improvement, and inspection. Homeowner shall exercise this right of access in a reasonable manner. Failure to comply will result in the Homeowner’s right to terminate the lease agreement.

6. Rental Rate and Fees:
a. Deposit: The deposit is for security and shall be refunded within 14 days of the Checkout Date, provided no deductions are made due to:
i. damage to the property or furnishings;
ii. dirt or other mess requiring excessive cleaning; or
iii. any other cost incurred by Homeowner due to Guest’s stay.
iv. Violation of the RENTAL RULES

7. Liability: Guest and all members of the Rental Party personally assume all risks of property loss or damage and physical injury or death that exist or may exist in connection with use or occupancy of the Property. Guest and all members of the Rental Party release Homeowner from any claim for damage, accident or injury that Guest and any members of the Rental Party may sustain from use or occupancy of the Property during the term of this Lease Agreement and agree to indemnify, hold harmless and defend Homeowner from any claim, action or proceeding by Guest and all members of the Rental Party, their family, estate, heirs or assigns related to a claim for damage, accident or injury during the use or occupancy of the Property. This property contains certain amenities, including, but not limited to pool, hot tub, stereo, etc. Guest acknowledges and agrees that Guest shall expressly assume the risk of such amenities and that Guest shall waive any claims against Homeowners in connection with the use of these amenities. Homeowners shall not be held responsible for any loss of property while on the property; due to theft or any other reason. Guest agrees to keep doors and windows locked while away from the property. Homeowners are not responsible for any theft to property while Guest is in residence. Guest agrees to indemnify and hold Homeowners harmless from and against any and all third-party claims, costs, expenses, damages, and liabilities, including reasonable outside attorneys’ fees and costs, caused by the negligence, willful misconduct and/or breach of this Agreement by Guest, its agents and/or invitees.

8. Assignment: Guest shall not assign the lease or sublet the Property. Failure to comply will result in the Homeowner’s right to terminate the lease agreement immediately. The terms of this Agreement will be governed by and interpreted under the laws of the State of Texas, Dallas County.

9. Cancellation Policy: This agreement is subject to the cancellation policy of the site on which it is was booked. Please see the site for information on the cancellation policy.
- Cleaning fees will be refunded if the guest did not check-in.
- If a guest has a complaint, notice must be given to us and booking site within 24 hours of check-in.
- Airbnb/VRBO will mediate when necessary and has the final say in all disputes.

10. Payment
Payment is received through the Airbnb or HomeAway processing system. The parties agree to the terms of this Lease Agreement.

1. Absolutely no smoking permitted inside the home. If smoking outside, all windows/doors must be closed. Any smell of smoke in the home will result in a full loss of security deposit.

2. Drugs, weapons, and illegal activity of any kind is strictly prohibited at all times.

3. Guests are not allowed to exceed the number of guests stated on the reservation. Any other person on the property is the sole responsibility of Guest. Any additional guests found at the house over the agreed-upon number will be charged a $200/guest/night fee which will be taken from the deposit.

4. A major request we have is to please refrain from loud or disturbing noises at all times of the day, and especially after 10 pm. Code-enforced neighborhood quiets hours are from 10 pm – 8 am, but we ask that any music is turned off in the backyard by 9 pm. There are no large parties allowed at the house and no amplified music allowed ever. Pool and backyard use are not permitted from 10 pm-8 am. All guests should move into the home after 10 pm, and no one should be in the backyard or in the pool after this time. If we receive a neighbor complaint, our manager will contact you, and there will be a $250 fine. If we get a 2nd complaint after we have contacted you, you will lose your entire security deposit of $1000. Please note: If we are unable to get a hold of you, you will still be charged. Just because you do not answer or respond to us, does not mean you will not receive penalties for the complaint. It is your responsibility to provide a secondary number if you want us to attempt to contact two phone numbers in case of a complaint or emergency. The Dallas City Code must be strictly adhered to and noise complaints and/or violations can result in a complete (100%) loss of deposit and could result in an immediate termination of our lease agreement. Dallas City Code states: “The following loud and disturbing noises and vibrations are presumed to be offensive to the ordinary sensibilities of the inhabitants of the city: The playing of any radio, phonograph, television, or musical instrument with such volume as to disturb the peace, quiet, comfort, or repose of persons in any dwelling, apartment, hotel, or other type of residence.”

5. Events or parties of more than 16 people are not allowed. If you plan to have anyone other than the confirmed guests on the property, please let us know and get written approval before check-in. Failure to comply will result in a full loss of security deposit and a termination of our lease agreement.

6. Any and all vendors must be disclosed. We require the name and phone number to any companies that you have hired that will be coming onto the property.

7. Be respectful of neighbors and keep music at a very reasonable level at all hours of the day. You are welcome to use the speakers we provide, but we prefer that you keep all music indoors. If you do play music outside, it has to be quiet enough to NOT be heard over the fence, and it must be turned off by 9pm. Amplified music is never allowed and will result in a complete loss of deposit. Additionally, no one should be outside between 10pm and 8am. Noise complaints from neighbors at any time of the day will result in a partial or complete loss of the security deposit. Please see rule #4 for noise complaints and fines.

8. The Homeowner is not responsible for any accidents, injuries or illness that occurs while on the Property. The Homeowners are not responsible for the loss of personal belongings or valuables of the guest. By accepting this reservation, it is agreed that all guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise.

9. Keep the property and all furnishings in good order. Use appliances only for their intended uses. Household items (sheets, towels, utensils, dishes, etc.) are not to be removed from the Property. If there is damage to household items, you will be responsible for replacement/repairs. All furnishings, including patio furniture, must be put back in its original location before check-out. Failure to do so could result in excessive cleaning fees.

10. Pets are permitted only with written approval directly from the homeowner AND a pet fee that must be received prior to arrival. Please inquire. Failure to make Homeowner aware of a pet or failure to pay the pet fee prior to arrival will result in a full loss of the security deposit.

11. There is no daily housekeeping service. Linens and bath towels are included in the rental rate. Please be respectful of towels and linens and utilize the black towels for makeup. If towels or other linens are stained and ruined during your stay, you will responsible for replacement. In the off-chance you find a stain on the linens at check-in, please notify us immediately and send a picture so you will not be held responsible.

12. Please properly clean the outdoor grill and cover it after each use. Failure to do so will result in an extra $50 cleaning fee.

13. Trash: Any trash must be stowed in the proper bins.

14. Check-out time: Our standard check-out time is 11am unless you have received written approval on a later time. We ask that every person in your party and all personal belongings are out of the house by your check-out time. If you have not left by this time, a late check-out fee ($50 for every 30 minutes) will be assessed.


1. Guest is free to heat the spa and pool at their leisure.

2. Do not remove the Polaris/pool sweeper. Doing so will result in a $150 fine. If there is damage, you will be held responsible for the cost of repairs in addition to the $150 fine.

3. Do not use glassware or glass bottles in or near the pool as you or a future guest could be seriously injured. Please use plastic cups for any poolside drinks. If glass is found in the pool, you will be responsible for the costs associated with getting the glass out.

4. No lifeguard on duty. Swim at your own risk.

5. Children are allowed to swim or play in the pool only when adults are present. Please maintain constant supervision over children.

6. No pets in the pool.

7. We have provided some pool floats that you are welcome to use. Please put pool floats back where you found them (on the patio behind the blue couch) before your check-out to avoid a $50 excessive cleaning fee.

8. Walk slowly in the pool area. No roughhousing, dunking, pushing, or wrestling.

9. Keep the area clear of clutter, debris and toys. Toys can often attract young children to the pool.

10. Pool (and Backyard) hours are from 8am-10pm. For your safety, please do not swim in rainy weather or in thunderstorms.

11. Keep doors to the pool area closed and locked at all times.

Lastly, please treat our home as if was yours, please be respectful of our personal items, and please have fun! ;)

Owner reserves the right to hold partial or entire deposit or evict Guests if there is a violation of these rules.

This involves noise, interactions with others, and the aesthetic of the home and property. While this home is very private, the conduct of the guests is expected to be that of a respectable neighbor. Basically, treat this home and neighborhood in the same way as if you lived there.
